Methods of action towards rights violations because or further to the installation of a transnational company

Monday 8 November 2010 by Plateforme DESC Mali

Intervention context

  • Mali, a 1 241 300 Km2 territory
  • Nigerian Office:
  • a 960 000 ha natural site

Some of the Nigerian Office exploiters

- Millenium Challenge Corporation (Millenium Challenge Account): 14 000 ha from which 5200 ha will be converted for 35.7 billion FCFA for 1030 exploiters

- European Union: 2500 ha for 19.7 billion FCFA for 1150 exploiters

- Tomota Company: 100 000 ha, private farm

- Malibya Company: 50 years repeatable 100 000 ha free land for a private farm

So why so much fuss?

- Unawareness of the agricultural investment Convention
- Construction of a 40 km and 130m3 canal water supply by CGC (China) : Population eviction, destruction of houses and cemeteries, cultural heritage destruction

Actions, methods and resources

  • Surveys, investigations and individual and collective interviews with the people and public administration officials and MALIBYA Company;
  • Information retrieval enabled to have the Convention and the environmental study
  • Organisation of seminars to exchange about problematic with the people, the administration and the Malibya Company

Achieved results

  • Information to the people about the investment Convention signed between Mali and Libya in 2008 on the farming of 100 000 ha
  • Accomplishment of an environmental study
  • Publication of press articles mobilizing different actors concerned by the issue
  • Mobilization of the people to be compensated by the State, responsible for the eviction

Difficulties encountered

  • Access to information
  • Excessive zeal of some dishonest public administration officials
  • Vastness and enclosure of the country
  • States’ weakness makes them vulnerable to pressure from the multinational companies

Action perspectives

  • Pursuance of social mobilization and communities’ victims of ground rent expropriation organization
  • Pursuance of negotiations with Malibya Company and the State for possible compensations for the evicted people
  • Pursuance in developing right holders’ abilities in claiming their human rights to land

Recommendations

  • Intensifying multi-actors seminars to develop different actors’ skills and to consolidate pressure on the right holders regarding the issue;
  • Increased alliances both at a State level and within national and international civil society;
  • Information on the jurisprudence cases for advocacy
